Puddles Terms of Service
These terms govern your club's subscription to Puddles and your use of it as a member. By using Puddles, your club (through the person who set up its subscription) and you (as an individual user) both agree to these terms.
01Who we are
Puddles is operated by Oliver Ginns, trading as Puddles ("Puddles", "we", "us"), of Lords Oak, Landford, Salisbury, SP5 2DW, United Kingdom. Contact us at puddlesrowing@gmail.com.
02Who these terms apply to
Puddles is provided to rowing clubs ("your club", "the club") as the paying customer, and used by individual club members ("you", "users") under an invite-only account created via a join link from the club.
- Your club is responsible for who it invites, and for managing member permissions and committee roles within the app.
- As an individual user, your use of Puddles is also subject to these terms, particularly the acceptable use rules in section 6.
03The service
Puddles is a training and squad-management tool: session planning and sign-up, availability tracking, crew and cox assignment, training logs, coaching feedback, and related club-administration features. We may add, change, or remove features over time as the product develops.
04Accounts and registration
- You must provide accurate information when registering and keep your password secure. You're responsible for activity that happens under your account.
- Accounts are invite-only, issued via your club. If you leave your club, your club's committee can remove your access.
- Tell us promptly at puddlesrowing@gmail.com if you suspect unauthorised use of your account.
05Subscription, fees, and payment
- Puddles is a paid subscription service for clubs, billed at the fee and frequency (monthly or annual) agreed when your club subscribes.
- Fees are payable in advance for each billing period and are non-refundable except where required by law or where we agree otherwise in writing.
- We may change our fees for future billing periods; we'll give your club at least 30 days' notice of any change before it takes effect.
- If a subscription payment fails or is overdue, we may suspend the club's access to Puddles until payment is resolved, after reasonable notice.
06Acceptable use
When using Puddles, you agree not to:
- Use the service for any unlawful purpose, or in a way that infringes anyone else's rights
- Attempt to gain unauthorised access to accounts, data, or systems that aren't yours
- Upload content that's abusive, harassing, defamatory, or otherwise inappropriate for a club environment
- Interfere with or disrupt the service, or attempt to reverse-engineer or scrape it
- Share your account credentials with anyone else
We may suspend or terminate access for a user or a club that breaches these rules, particularly where it affects the safety or experience of other members.
07Your content and data
- Your club, and its members, retain ownership of the data entered into Puddles (rosters, training logs, session data, and so on).
- By using Puddles, you grant us the right to store, process, and display this data as needed to provide the service, in line with our Privacy Policy.
- Clubs are responsible for the accuracy of the data they and their members enter, and for having a lawful basis to share any member data with us (which invite-only registration and member consent generally satisfies).
08Availability and support
We aim to keep Puddles available and reliable, but as a small, actively-developed product we don't guarantee uninterrupted access. We may carry out maintenance, and will aim to give notice of any planned downtime likely to affect club activity (e.g. around session sign-up windows) where practical.
09Intellectual property
The Puddles software, design, and branding belong to us. Nothing in these terms transfers ownership of Puddles itself to your club or its members — you're licensed to use it as a service, not to copy or resell it.
10Limitation of liability
- We provide Puddles with reasonable care and skill, but to the extent permitted by law, we exclude liability for indirect or consequential losses (such as lost time, lost opportunity, or missed outings) arising from use of the service.
- Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that can't lawfully be excluded.
- Our total liability to your club for any claim arising from these terms is limited to the fees paid by your club in the 12 months before the claim arose.
11Termination
- Your club can cancel its subscription at any time by contacting us; access continues until the end of the paid billing period.
- We may terminate or suspend a club's access for material breach of these terms, non-payment, or if we stop offering the service, with reasonable notice where practical.
- On termination, your club can request an export of its data within a reasonable period, after which we'll delete or anonymise it in line with our Privacy Policy.
12Changes to these terms
We may update these terms from time to time, for example as Puddles' features or pricing structure change. We'll update the version number and date above, and notify clubs of material changes.
13Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
